Agreement to Terms

By accessing or using PixelMelon's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Our Services

PixelMelon provides web design, web development, branding, e-commerce, SEO, and mobile optimization services. Each project is unique, and specific terms will be outlined in your individual project proposal and contract.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to active clients.

Project Engagement

Consultation: Initial consultations are free and do not obligate either party to proceed with a project.

Proposals: Project proposals are valid for 30 days from the date of issue. Pricing and scope may change after this period.

Contracts: All projects begin with a signed contract that outlines the scope, timeline, deliverables, and payment terms.

Payment Terms

Setup Fees: One-time setup fees are due upfront before project work begins.

Monthly Fees: Ongoing monthly service fees are billed automatically on the agreed-upon date each month.

Payment Methods: We accept all major credit cards. Custom payment arrangements may be available for larger projects.

Late Payments: Services may be suspended if payments are more than 15 days overdue. A late fee may apply.

Project Timeline & Revisions

Timelines: Project timelines are estimates and may vary based on complexity, scope changes, and client feedback response times.

Revisions: Each project package includes a specified number of revision rounds. Additional revisions may incur extra charges.

Client Responsibility: Timely feedback and content provision are essential. Delays in client responses may extend project timelines.

Intellectual Property

Client Ownership: Upon full payment, you own the final deliverables (designs, code, content) created specifically for your project.

Third-Party Assets: Any third-party assets (fonts, stock photos, plugins) are subject to their respective licenses.

Portfolio Rights: We retain the right to showcase your project in our portfolio and marketing materials unless otherwise agreed in writing.

Monthly Service Plans

Service Included: Monthly plans include hosting, SSL certificates, backups, maintenance, and support as outlined in your specific package.

Cancellation: You may cancel your monthly service with 30 days written notice. You'll retain all files and can transition to self-managed hosting.

Service Suspension: We reserve the right to suspend services for non-payment or violation of these terms.

Website Content

You are responsible for ensuring that all content you provide (text, images, videos, etc.) does not violate any laws or third-party rights.

We are not responsible for any legal issues arising from content you provide or approve for your website.

Warranties & Disclaimers

Quality Commitment: We strive to deliver high-quality work that meets your expectations and industry standards.

No Guarantees: We cannot guarantee specific results (traffic, sales, rankings) as these depend on many factors outside our control.

Third-Party Services: We are not responsible for issues caused by third-party platforms, hosting providers, or services beyond our control.

Limitation of Liability

To the maximum extent permitted by law, PixelMelon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of our working relationship. This does not apply to information that is publicly available or required to be disclosed by law.

Termination

Either party may terminate a project or ongoing service with written notice as specified in your individual contract.

Upon termination, you'll receive all completed work to date. Payments for work completed are non-refundable.

Changes to Terms

We may update these Terms of Service from time to time. We will notify active clients of any significant changes. Your continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
